CAR CHASER
Effective Date: 07 April 2026
“Platform” means the Car Chaser website and mobile applications.
“Services” means all services provided through the Platform.
“User” means any person accessing or using the Platform.
“Buyer” means a User purchasing or bidding on a vehicle.
“Seller” means a User listing a vehicle, including dealers.
Car Chaser operates as an online marketplace facilitating transactions between Buyers and
Sellers.
Car Chaser:
(a) Is not a party to any sale.
(b) Does not own, inspect, or take possession of vehicles.
(c) Does not act as a dealer, broker, or agent unless expressly stated.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree,
you must not use the Platform.
Users must:
(a) Be at least 18 years old.
(b) Provide accurate and complete information.
(c) Maintain the confidentiality of their account credentials.
Car Chaser reserves the right to suspend or terminate accounts at its discretion.
Users shall not:
(a) Submit false or misleading information.
(b) Engage in fraudulent or deceptive conduct.
(c) Interfere with the operation of the Platform.
(d) Place bids without intent to complete a purchase.
Sellers are solely responsible for the accuracy of listings.
Car Chaser does not verify:
(a) Vehicle condition.
(b) Ownership status.
(c) Accuracy of descriptions.
All vehicles are offered subject to Seller representations only.
7.1 Binding Bids
All bids are final, irrevocable, and legally binding.
7.2 Reserve Price
A Seller may set a minimum reserve price.
7.3 Automatic Sale
A legally binding sale is formed immediately when:
(a) The reserve price is met; or
(b) The buy Now price is met.
7.4 No Withdrawal
Bids may not be withdrawn or modified.
7.5 Platform Control
Car Chaser reserves the right to suspend, cancel, or restart auctions in cases of:
(a) Fraud;
(b) Technical error;
(c) Legal requirement.
Buyers must complete payment within forty-eight (48) hours of a successful bid.
Failure to complete payment may result in:
(a) Cancellation of the transaction.
(b) Suspension or termination of the account.
(c) Resale of the vehicle.
All vehicles are sold strictly:
“AS-IS, WHERE-IS”
Buyers acknowledge that they are solely responsible for conducting due diligence before
purchase.
Where a Seller is a dealer in Québec:
(a) The dealer is considered a “merchant” under applicable law;
(b) A legal warranty of quality may apply, notwithstanding any disclaimer;
(c) The dealer must disclose all material facts, including defects and prior damage.
Car Chaser is not responsible for the enforcement of such obligations.
Where shipping is arranged:
(a) All shipping, duties, and taxes are the responsibility of the Buyer;
(b) Risk transfers to the Buyer upon delivery to the carrier.
Car Chaser is not liable for shipping delays, loss, or damage.
The Platform and Services are provided “as is” and “as available.”
Car Chaser makes no warranties, express or implied, including:
(a) Accuracy of listings;
(b) Availability of the Platform.
(c) Condition of vehicles.
To the maximum extent permitted by law, Car Chaser shall not be liable for:
(a) Indirect or consequential damages.
(b) Loss of profit, data, or business;
(c) Vehicle condition or transaction disputes.
Total liability shall not exceed fees received by Car Chaser.
You agree to indemnify and hold Car Chaser harmless from any claims arising from:
(a) Your use of the Platform.
(b) Breach of these Terms.
(c) Disputes with other Users.
Car Chaser may suspend or terminate access at any time for breach of these Terms.
These Terms are governed by the laws of Ontario, Canada, with applicable consumer protection
laws of Québec where required.
